Terms & conditions for ticket holders and condition of entry

 

By visiting Toby’s Garden Festivals, you accept the following terms and conditions and agree to abide by the instructions of the management team and stewards at all times.

Tickets are valid for one day of the festival only. Dogs are welcome on short leads. Please do not leave your dog in your car.

Tickets are non-refundable and non-transferable. No refunds will be made for unused tickets. Duplicate tickets will not be issued for lost or stolen tickets or where the ticket holder cannot attend the festival due to reasons beyond the Festival’s control.

Advance tickets for a specific day of the festival may be used on the other day of the festival provided the surcharge for the full gate price is paid.

Toby’s Garden Festivals Ltd reserve the right to change the advertised programme and exhibitor list at any time.

The ticket price covers entry to the festival and speakers, and to some parts – not all – of both Powderham Castle and Forde Abbey, depending on which event you are attending.  

In order to facilitate the security, safety and comfort of all customers and staff Toby’s Garden Festivals reserves the right to remove from the festival without refund, anyone it deems to have behaved in a manner which has, or is likely to, affect the safety and enjoyment of other visitors or staff.

Admission is at the ticket holder’s own risk. Toby’s Garden Festivals Ltd will not be held liable for any loss, injury or damages sustained at the event, including any damage, theft of loss to property or vehicles, if the cause is due to the negligence of the ticket holder or the actions of other patrons, ticket holders, third parties of force majeure.

Children under 16 must be accompanied by a responsible adult over 18 at all times.

Tickets must not be used as prizes or as part of any marketing, media, sales promotion, staff reward programme or general competition use whether commercial or non-commercial without prior written permission from the organisers. Toby’s Garden Festivals logos may not be used without the express permission of the organisers.

Please note that by attending Toby’s Garden Festivals, you are attending an event where photography, audio, and video recording may occur. By entering the event premises, you consent to interview(s), photography, audio recording, video recording and its/their release, publication, exhibition, or reproduction to be used for news, web casts, promotional purposes, telecasts, advertising, inclusion on websites, social media, or any other purpose by Toby Buckland Garden Festivals Ltd and its affiliates and representatives. Images, photos and/or videos may be used to promote similar GPC events in the future, highlight the event and exhibit the capabilities of TBGF Ltd. You release the organisers, its officers and employees, and each and all persons involved from any liability connected with the taking, recording, digitizing, or publication and use of interviews, photographs, computer images, video and/or or sound recordings. By entering the event premises, you waive all rights you may have to any claims for payment or royalties in connection with any use, exhibition, streaming, web casting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such use, exhibiting, broadcasting, web casting, or other publication irrespective of whether a fee for admission or sponsorship is charged. You also waive any right to inspect or approve any photo, video, or audio recording taken by TBGF Ltd or the person or entity designated to do so by the organisers.

Entrance to the festival prohibits the use of photographic or filming equipment on the Festival site for commercial gain without the Festival organisers’ written consent and anyone taking photographs, making films, sound recordings or broadcast for commercial gain without permission will be denied entry or removed from the festival site.

No ambush marketing is allowed and no charitable collections unless you have our express permission.

We reserve the right to restrict access to areas of the Festival in the event of extreme weather conditions.

Entry to the Festivals is at your own risk. We will not be liable for any loss, theft or damage including to any person who enters the venue, your personal belongings or any vehicle or its contents in any car parks.
We reserve the right to change the terms and conditions from time to time.

 

Other information

Toby’s Garden Festivals Ltd accepts no responsibility for goods or services purchased from third party traders.

Please use the litterbins and recycling bins provided.

Medical treatment at the festival is provided by Rapid Emergency Medical who are a separate legal entity. Any claims resulting from medical treatment on site should be directed to Rapid Emergency Medical. Toby’s Garden Festivals Ltd accept no liability for any injury, claim or damages resulting from any medical treatment on site.

Smoking is no permitted inside any of the enclosed areas.

No responsibility is accepted by Toby’s Garden Festivals Ltd for damage incurred in the car park no matter how incurred.


Terms & conditions for exhibitors

Space is allocated for both days of the festival, hours of operation are 10am-5pm. No camping is allowed on site although camping is available in the parking fields nearby on request for a small charge. Exhibitors are expected to sell goods as described in their application, any changes must be requested in writing at least two weeks before the event.

Allocation and positioning of exhibitor space is at the discretion of Toby’s Garden Festivals. Once paid for exhibitor space is non-refundable within 14 days of the festival opening.

All vehicles must be kept off site in the exhibitor car parks unless part of the exhibit itself, half an hour before the festival starts. No vehicles are allowed on site during the hours when the festival is open. No dogs/animals allowed on site at Powderham Castle due to the deer. We reserve the right to delay or restrict access to the festival site if necessary for reasons of health and safety or on advice from the police or council officials.

Set up is from 9am the day before the festival, or at other times only on request. Breakdown is from 5pm on the final day, all exhibitors must be off site by the next day at the latest unless special permission has been gained to stay longer.

No refunds are given to exhibitors in the event of poor weather, nor as a result of changes to exhibitor siting or changes to the advertised programme.

The exhibitor shall fully indemnify Toby’s Garden Festivals Ltd against all proceedings, costs, claims, demands and liability howsoever arising, whether directly or indirectly , in connection with the exhibitor’s occupation at the festival and in particular (but without limitation to the generality of the foregoing) shall indemnify Toby’s Garden Festivals Ltd against any liability for injury or death of any person and loss or damage to any property howsoever caused.

The exhibitor shall provide public liability insurance for an indemnity of not less than £5 million in respect of any one occurrence. The exhibitor must also hold employers liability insurance cover and copies of all insurance must be provided before the event and be available for inspection on request by the management team.

Toby’s Garden Festivals Ltd accepts no responsibility for loss or damage to the property of the exhibitor or that of their employees or visitors.

In the event of the festival being postponed or abandoned, or in the event of supplies, services of facilities being unavailable due to circumstances beyond the control of Toby’s Garden Festivals Ltd, we shall not be liable for any expenditure, loss, damage or liability incurred by the exhibitor.

The sale of weapons, fireworks, tobacco products and illegal drugs is prohibited as well as barbecue for use on site.

Exhibitors are not allowed to sub-let their pitch or pass it on for use to another exhibitor, in the event they are unable to make use of it themselves.

No PA address system is allowed from any exhibitor pitch without prior permission.

Food exhibitors are encouraged to avoid the use of single-use plastics and to use compostable tableware. No glassware to be used on site or in the deer park. Food hygiene certificates and mobile vendor registration certificates must be provided before the festival. Equipment should be regularly checked and kept up to standard with the appropriate safety/PAT certification in respect of electrical equipment. Exhibitors must keep their pitches clean and free from waste and all food waste must be taken off site by the exhibitor.

Security is provided overnight during the festival but exhibitors are advised not to ensure the security of stock overnight where possible.

Toby’s Garden Festivals Ltd reserve the right to inspect pitches at any time and expel any exhibitor not adhering to these terms and conditions.
