Toby’s Garden Festival 2027

Ticket & Admission Terms and Conditions

Last updated: September 2026

These Terms and Conditions apply to tickets purchased for and admission to Toby’s Garden Festival 2027 (“the Festival”).

The Festival is organised by The Garden Fest Co Ltd (“we”, “us”, “our” or “the Organiser”), a company registered in England and Wales under company number 09881686, whose registered office is at 26–28 Southernhay East, Exeter, Devon, United Kingdom, EX1 1NS.

Our Festival correspondence address is Unit 8 Hogsbrook Farm, Woodbury Salterton, Exeter, EX5 1PY.

By purchasing or using a ticket for the Festival, you agree to these Terms and Conditions. Please read them carefully before purchasing your ticket.

1. Tickets and admission

Tickets are valid for admission to the Festival on the date stated on the ticket, subject to these Terms and Conditions.

Each ticket or unique ticket barcode/QR code permits one admission only. Tickets that have been copied, altered, obtained fraudulently or are otherwise invalid may be refused.

Please keep your ticket safe. We cannot accept responsibility for tickets that are lost, stolen or used by another person without your permission.

Tickets are subject to availability and we may stop selling tickets for a particular day if the Festival reaches its permitted or safe capacity.

We reserve the right to refuse admission where reasonably necessary for safety, security or where these Terms and Conditions have been breached.

2. Changing the day of your visit

We understand that plans can change. If you have purchased a ticket for a specific day of the Festival, you may request to change your ticket to the other Festival day up to 7 days before the Festival, subject to ticket availability for the requested day.

To request a change, please contact us at info@tobygardenfest.co.uk and provide your booking details.

Date changes are not guaranteed and can only be made where tickets remain available for the requested day.

Requests to change the date of attendance made within 7 days of the Festival may not be accommodated.

If there is a difference in ticket price between the original booking and the requested Festival day, you may be required to pay the difference. No refund will normally be given where the ticket price for the new date is lower.

Changing the date of your ticket does not otherwise affect these Terms and Conditions.

3. Refunds and cancellation by ticket holders

Tickets are non-refundable where you simply change your mind or are unable to attend, except where required by law or otherwise expressly stated in these Terms and Conditions.

If your plans change, you may request to move your ticket to the other Festival day in accordance with Section 2 above.

Tickets for leisure events taking place on a specified date or during a specified period are not normally subject to the statutory 14-day cancellation period that applies to some online purchases.

We are not responsible for personal circumstances that prevent a ticket holder from attending, including illness, travel disruption or other circumstances outside the Festival’s control.

Nothing in these Terms and Conditions affects your statutory rights.

4. Cancellation, postponement or significant changes

We may need to cancel, postpone, reschedule or make changes to the Festival because of circumstances outside our reasonable control or where reasonably necessary for the safe and effective operation of the event.

If the Festival is cancelled by us and no replacement date is offered, ticket holders will be entitled to a refund of the ticket price paid, subject to any rights or remedies available under applicable law.

If the Festival is postponed or rescheduled, we will provide ticket holders with information about the arrangements for the replacement date and the options available to them.

Where a significant change is made that materially affects the event purchased, we will provide appropriate options in accordance with applicable consumer law.

We will communicate significant cancellation, postponement or rescheduling information through our website and, where practicable, using the contact details provided when the ticket was purchased.

We cannot be responsible for travel, accommodation or other expenses incurred in connection with attending the Festival, except where the law provides otherwise.

5. Weather and circumstances beyond our control

Toby’s Garden Festival is an outdoor event and will normally proceed in varying weather conditions.

Visitors should check the weather forecast and dress appropriately for the conditions.

For safety reasons, we may temporarily close or restrict access to parts of the Festival, alter activities or make other reasonable operational changes because of adverse or extreme weather.

We may also make changes where circumstances beyond our reasonable control affect the safe or practical operation of the Festival. Such circumstances may include severe weather, fire, flood, epidemic or pandemic, acts or requirements of government or public authorities, security incidents, failure of essential services or other events that we could not reasonably prevent.

Where such circumstances result in cancellation, postponement or a significant change to the Festival, the provisions in Section 4 will apply.

6. Programme, speakers and exhibitors

Festival programmes, speakers, demonstrations, activities and exhibitor lists are correct to the best of our knowledge when published but may be subject to change.

We reserve the right to make reasonable changes to the advertised programme, timings, speakers, exhibitors, demonstrations and activities where necessary.

The withdrawal or substitution of an individual speaker, exhibitor, demonstration or activity will not normally entitle a ticket holder to a refund where the Festival as a whole continues substantially as advertised.

7. What your Festival ticket includes

A standard Festival admission ticket provides entry to Toby’s Garden Festival and access to the talks, demonstrations and activities stated as being included with general admission.

Some workshops, hospitality, food and drink, VIP packages, special experiences and other activities may require a separate ticket or additional payment.

Festival admission may also include access to designated parts of Powderham Castle. It does not provide unrestricted access to all areas of the Castle or Estate.

Any areas included with Festival admission will be identified at the event or in the Festival information published before your visit.

8. Children

Children under the age of 16 must be accompanied by a responsible adult aged 18 or over.

Parents, guardians and accompanying adults are responsible for the supervision of children in their care while attending the Festival.

We reserve the right to restrict children’s access to particular activities or areas where this is reasonably necessary for safety.

9. Dogs and assistance dogs

Well-behaved dogs are welcome at the Festival provided they are kept under proper control and on a short lead at all times.

Dog owners are responsible for their dog’s behaviour and welfare and must clean up after their dog.

Dogs must not be left unattended or left in vehicles.

For the safety and enjoyment of visitors, other animals and wildlife, we reserve the right to require a dog to be removed from the Festival if it is behaving aggressively, causing significant disturbance or is otherwise considered to present a safety or welfare concern.

Access for assistance dogs will be accommodated in accordance with applicable law. Visitors with particular accessibility requirements are encouraged to contact us in advance if they would like information about the Festival site.

10. Accessibility

We want Toby’s Garden Festival to be as accessible and welcoming as reasonably possible.

Information about accessibility, accessible parking and any companion or personal-assistant ticket arrangements will be published on the Festival website.

Visitors who require reasonable adjustments or have particular accessibility requirements are encouraged to contact us before attending so that we can provide relevant information and, where reasonably possible, assistance.

Nothing in these Terms and Conditions affects our obligations under applicable equality legislation.

11. Visitor behaviour and safety

Visitors must follow reasonable instructions given by Festival management, stewards, security personnel, emergency services and venue staff.

We may refuse admission to, or remove from the Festival without refund, any person who:

  • behaves in an abusive, threatening, discriminatory, dangerous or seriously disruptive manner;
  • is intoxicated to an extent that creates a safety concern or significant disturbance;
  • possesses a prohibited or unlawful item;
  • damages Festival, venue, exhibitor or other property;
  • enters an unauthorised or restricted area;
  • fails to follow reasonable safety or security instructions; or
  • otherwise behaves in a way that is reasonably considered likely to affect the safety or enjoyment of visitors, exhibitors, staff or other people at the Festival.

Where admission is refused or a visitor is removed because of their own breach of these Terms and Conditions, no refund will normally be provided.

12. Prohibited activities and items

Visitors must not bring illegal drugs, weapons, fireworks or other items that we reasonably consider dangerous onto the Festival site.

Unauthorised trading, advertising, leafleting, promotional activity, ambush marketing and charitable collections are not permitted without our prior written approval.

We reserve the right to introduce additional reasonable safety or security restrictions where necessary and will communicate these where practicable.

13. Photography and filming by visitors

Visitors are welcome to take photographs and short videos for their own personal, non-commercial use, provided this does not interfere with the enjoyment, safety or privacy of others.

Professional or commercial photography, filming, sound recording or broadcasting at the Festival requires our prior written permission.

Photography, filming or recording must not be used for commercial gain without our permission.

We reserve the right to ask anyone undertaking unauthorised commercial photography, filming or recording to stop and, where appropriate, to leave the Festival.

14. Official Festival photography and filming

Official photographers, videographers and other media may be present at Toby’s Garden Festival.

Photography, video and audio recorded at the Festival may be used by The Garden Fest Co Ltd for legitimate editorial, publicity, promotional, archive and Festival communication purposes, including on our website, social media, printed materials and other marketing channels.

We will handle personal information contained in photographs and recordings in accordance with applicable data-protection law and our Privacy Policy.

Where appropriate, we will take reasonable steps to make visitors aware that official photography or filming is taking place.

If you have concerns about being photographed or filmed, please speak to a member of the Festival team. Where reasonably practicable, we will seek to accommodate requests not to be included in identifiable promotional photography or filming.

Additional consent may be sought where appropriate, particularly for certain close-up, posed or individually focused promotional photography or filming.

Further information about how we use personal information is available in our Privacy Policy.

15. Independent exhibitors and traders

Toby’s Garden Festival brings together independent exhibitors, traders, food businesses and other third-party suppliers.

Unless expressly stated otherwise, goods and services purchased directly from an independent exhibitor or trader are supplied by that business and the contract for that purchase is between you and the relevant trader.

Any questions, complaints, refunds or other issues relating to those goods or services should ordinarily be raised directly with the trader concerned.

Nothing in this section affects any rights you may have under applicable consumer law.

16. Medical assistance

First-aid and medical assistance will be available at the Festival.

Medical services may be provided by an independent professional medical provider appointed for the event.

Nothing in these Terms and Conditions excludes or limits any liability that cannot lawfully be excluded or limited.

In an emergency, visitors should immediately alert a member of Festival staff, security or the medical team.

17. Personal property and vehicles

Visitors are responsible for their personal possessions while attending the Festival.

Please take reasonable precautions to protect valuables and do not leave belongings unattended.

Vehicles and their contents are left in Festival or venue car parks at the owner’s risk. We recommend that vehicles are locked and valuables are not left visible.

The Garden Fest Co Ltd will not be responsible for loss, theft or damage to personal property or vehicles except where such loss or damage results from our negligence or where liability cannot otherwise lawfully be excluded.

18. Liability

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Subject to the above, we are not responsible for loss or damage caused by:

  • the acts or omissions of visitors or other third parties for whom we are not legally responsible;
  • a visitor’s own negligence or failure to follow reasonable instructions;
  • circumstances outside our reasonable control; or
  • loss or damage that was not reasonably foreseeable when the ticket was purchased,

except where applicable law provides otherwise.

Nothing in these Terms and Conditions affects your statutory rights.

19. Smoking and vaping

Smoking and vaping are not permitted inside enclosed Festival areas or in any other area designated as non-smoking.

Visitors must comply with signage and instructions relating to smoking and vaping while on the Festival site.

20. Promotions, competitions and resale

Festival tickets may not be used as prizes, incentives or as part of a commercial promotion, competition, marketing campaign or staff reward programme without our prior written permission.

The Toby’s Garden Festival name, branding and logos may not be used for promotional or commercial purposes without our prior written permission.

Separate terms and conditions may apply to promotional offers, discount codes and competitions.

Tickets must not be resold or offered for resale in the course of a business or for commercial gain without our prior written permission.

21. Personal information

When you purchase a ticket or otherwise provide us with personal information, we will handle that information in accordance with applicable data-protection law and our Privacy Policy.

Our Privacy Policy explains what information we collect, why we use it, the lawful bases on which we rely, how long we retain it, who we may share it with and your data-protection rights.

Please see our Privacy Policy on the Toby’s Garden Festival website for further information.

22. Changes to these Terms and Conditions

We may update these Terms and Conditions from time to time, for example to reflect changes in law, safety requirements or Festival arrangements.

The Terms and Conditions applying to your ticket will normally be those in force when you purchased it. We will not make retrospective changes that unfairly reduce your contractual rights.

Where a change is required by law or is otherwise necessary and materially affects your booking, we will take reasonable steps to inform affected ticket holders.

23. Governing law

These Terms and Conditions are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you will also retain the benefit of any mandatory protections available to you under the law applicable to you.

Any dispute may be brought before the courts having jurisdiction under applicable law.
